The AS IS designation means the vehicle is sold without any warranty — the buyer accepts the vehicle in its current condition and assumes full responsibility for all repair costs after the sale. Under the FTC Used Car Rule (16 CFR Part 455), if you're selling a vehicle as-is with no warranty, you must use the AS IS version of the Buyers Guide. If you offer any warranty — even a limited powertrain warranty — you must use the warranty version instead. Using the AS IS form on a vehicle you're actually warranting is an FTC violation.
Q. Is this the correct form for all 50 states?
The standard AS IS Buyers Guide satisfies the federal FTC requirement in most states. However, a few states have additional requirements that modify the form. Maine, for example, requires a specific implied warranty disclosure. Wisconsin requires a different Buyers Guide format entirely. What the FTC Buyers Guide Requirement Actually Covers
The FTC Used Car Rule applies to any dealer who sells six or more used vehicles in a 12-month period. The rule requires:
Display requirement. A Buyers Guide must be displayed on every used vehicle while it is offered for sale. “Offered for sale” means any time a customer could inspect or inquire about the vehicle — including vehicles visible on the lot before any active sales conversation begins.
Content requirement. The Buyers Guide must use the FTC-approved format without material modifications. For AS IS sales, the form must clearly state that the vehicle comes with no dealer warranty and that the buyer bears all repair costs.
Retention requirement. At the time of sale, the buyer must receive a copy of the signed Buyers Guide. The dealer must retain a signed copy in the deal file. The FTC treats missing deal jacket copies as a separate compliance failure from the display requirement.

Use the AS IS form when: you are selling the vehicle with no warranty of any kind — no dealer warranty, no implied warranty. The buyer takes the vehicle in its current condition and is responsible for all repair costs after the sale.
Use the warranty form when: you offer any warranty — even a limited powertrain warranty for 30 days or 1,000 miles. The warranty form requires you to specify covered systems, duration, and the dealer’s percentage of covered repair costs.
Mixed situations. If you’re unsure whether your state imposes implied warranties that limit true AS IS sales (some states do), consult your state’s DMV guidelines or an automotive compliance attorney before using the AS IS form.
How to Apply the Exterior Buyers Guide
- Print your variable fields — run the blank form through your laser printer with vehicle year, make, model, VIN, asking price, and dealer information filled in
- Clean the glass — wipe the exterior window with a clean dry cloth
- Peel the border — remove the adhesive backing from all four perimeter edges
- Position and press — place the form in the upper corner of the driver’s side window (standard placement visible from outside), press firmly from center to edges
- Inspect edges — confirm all four borders are sealed against the glass, especially at corners
